This Measure is the “Cannabis Business Tax Measure,” and proposes a tax on cannabis (marijuana) businesses in the City of Pomona. The proposed ordinance broadly defines “cannabis business” as any business activity involving cannabis, including cultivating, transporting, distributing, manufacturing, compounding, converting, processing, preparing, storing, packaging, delivering, testing, dispensing, retailing, and wholesaling of cannabis, cannabis products, or ancillary products and accessories, whether or not carried on for gain or profit. The tax does not apply to the use of cannabis or the cultivation of cannabis for personal use as authorized under state law.

The City currently does not allow cannabis businesses within City boundaries, nor does the proposed ordinance allow cannabis businesses in the City. If this Measure is approved, the City will amend its Municipal Code to add an Article implementing the cannabis business tax on all cannabis businesses that operate in the City, whether or not such business is legally operating within City boundaries. The imposition of the tax on a cannabis business does not authorize or permit the otherwise illegal business activity.

This Measure places before the voters the decision of whether or not to create a tax on cannabis businesses at an annual rate of up to $10.00 per canopy square foot for cultivation, and up to 6% of gross receipts for all other cannabis businesses. If approved, the cannabis business tax is expected to generate an estimated $400,000 to $500,000 per year for general city services and purposes. These revenues could be used for all City services or programs, including increasing public safety activities and enforcement, crime prevention, and providing and maintaining other essential municipal services that support the residents and businesses in Pomona. The City Council may adjust the cannabis business tax rates as long as the adjusted rates do not exceed the maximum rates approved by voters. The cannabis business tax shall also be adjusted annually to reflect increases in the Consumer Price Index. This tax would remain in place until repealed by the voters.

On August 6, 2018, the City Council directed this Measure to be placed on the ballot at the General Municipal Election to be held on November 6, 2018.

A YES vote supports establishing a cannabis business tax on all cannabis businesses in the City of Pomona, regardless of whether those businesses are legally operating within City boundaries. The cannabis business tax revenues are expected to generate approximately $400,000 to $500,000 in general fund revenues per year, to be made available for public safety services and all other City programs and services.

A NO vote results in the City not implementing a cannabis business tax.

Vote YES on PC to ensure that the City of Pomona receives a fair share of tax revenue from local commercial cannabis businesses.

Measure PC will NOT cost local homeowners or residents one penny.

California voters approved Proposition 64 in 2016 to legalize the sale and use of recreational marijuana. Proposition 64 imposed state taxes on the production and sale of marijuana, but all revenue from these taxes goes directly to the State, and nothing is distributed directly to Pomona.

Measure PC will not authorize commercial cannabis activities and businesses in the city. Voting YES on PC simply allows our community to apply a fair and reasonable local tax structure should commercial cannabis activity be legalized in our community.

Measure PC will provide the financial resources necessary to regulate and oversee marijuana businesses without taking money away from existing programs.

Most importantly, this regulatory oversight ensures that marijuana businesses operate in a safe, legal manner and do not negatively impact our quality of life.

All funds generated by Measure PC must stay here in Pomona to support local programs and services. The State can’t take one penny.

Measure PC would generate a source of locally-controlled funding that will not only regulate commercial cannabis businesses, it will help maintain essential city services, including:
– Police and Fire protection
– Crime prevention
– Maintaining infrastructure, including our streets and roads
– Parks and recreation programs
– Drug abuse education and prevention

Many other cities across California have adopted similar cannabis taxes to benefit from marijuana sales in their communities. They have ensured that the necessary resources are available to combat potential negative consequences of marijuana legalization.
